

Debra Molock joined Best & Spruill, P.C. as an associate attorney in July, 2005.
Education
Ms. Molock earned a Bachelor of Arts in Psychology and in English from the East Texas State University in Commerce, Texas (now Texas A & M at Commerce). Ms. Molock graduated with Highest Honors and with Academic Distinction. She was the graduation senior with the highest academic average. She obtained a J.D. degree from the University of Texas School of Law in Austin, Texas in 1987. While at law school, Ms. Molock was a member of the Legal Research Board and received the Legal Research and Writing Award.
Prior Work Experience
Ms. Molock has worked as Assistant General Counsel in the State Office, contracts section and as Assistant Regional Attorney for the Texas Department of Human Services. She has also worked as a staff attorney for the Railroad Commission. She has worked for various law firms as a contract attorney.
Areas of Practice
Ms. Molock's practice primarily includes administrative law experience before state agencies involving Medicare and Medicaid contracts and employment law. Ms. Molock also has private practice experience in health care and employment law. Further, Ms. Molock has several years' experience reviewing legislation and drafting rules for various state agencies. In the Contracts Section of State Office Ms. Molock represented the Texas Department of Human Services in formal appeals before SOAH and DHS administrative law judges concerning contracting issues including Medicare and Medicaid contract suspension, termination, and vendor hold regarding Rate Analysis, Utilization Review and Community Care Contracting. Regarding Rate Analysis and nursing facilities, the cases concerned recoupment issues related to Enhanced Direct Care Staff Rate Implementation Reports. Rate Analysis and Community Care Contracting cases concerned possible sanctions of contract termination and vendor hold for failure to provide acceptable cost reports for long-term care programs including Community Based Alternatives, Primary Home Care, and Day Activity & Health Services and for failure to submit Final Attendant Compensation Reports, and Six-Month Attendant Compensation Reports. Utilization Review included Ms. Molock representing the Department in formal appeals of TILE issues. Ms. Molock also represented DHS in possible termination of Community Living Assistance and Support Services and Deaf-Blind Multiple Disabilities Waiver contracts for licensure termination. Also, while at DHS State Office, Ms. Molock reviewed more than 300 contract sanction packets concerning Community Care Contracting programs. Further, while at this State Office Ms. Molock represented the Department at Nursing Facility Administrator Informal Reviews. As Assistant Regional Attorney at DHS, Ms. Molock represented the Department in enforcement proceedings against nursing home facilities, medication aides, nurse aides and nursing facility administrators. In addition, Ms. Molock represented DHS at personnel grievance hearings and at Texas Workforce unemployment hearings. In private practice, Ms. Molock drafted healthcare employment contracts and pleadings regarding healthcare issues before SOAH and CMS.
